1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the WheelHouse platform operated by Wagon Wheel Trading ("we," "us," "our"). By accessing or using our website at wagonwheeltrading.com, creating an account, or using any of our tools, features, or services, you ("you," "user") agree to be bound by these Terms. We reserve the right to update these Terms at any time. Continued use of the service after changes constitutes acceptance of the revised Terms.

2. Not Financial Advice

    WheelHouse is NOT a financial advisor, investment advisor, broker-dealer, or fiduciary of any kind. Nothing on this website constitutes financial advice, investment advice, trading advice, or any other form of professional advice. All content, data, scores, recommendations, trade ideas, backtest results, analysis, and educational materials are provided for informational and educational purposes only.
  

Specifically:

We do not recommend any specific securities, options contracts, or trading strategies for you to buy, sell, or hold.
We do not provide personalized investment advice tailored to your individual financial situation, risk tolerance, or investment objectives.
The "Trade Ideas" feature, "Quick Verdict" scores, "Bulls vs Bears" analysis, and any other tool output are algorithmic outputs based on publicly available market data, not recommendations to trade.
Backtest results show hypothetical, simulated performance that does not reflect actual trading. Past performance, whether real or simulated, is not indicative of future results.
Blog posts, educational content, and the Learn page are for general education only and should not be relied upon as advice for any specific trade or investment decision.

3. Not a Registered Investment Advisor

Wagon Wheel Trading is not registered as an investment adviser with the U.S. Securities and Exchange Commission (SEC) or any state securities regulatory authority. We are not a broker-dealer registered with the Financial Industry Regulatory Authority (FINRA). We do not hold any securities licenses. Nothing on this platform should be construed as an offer or solicitation to buy or sell securities.

4. SEC and Regulatory Compliance

Options trading is regulated by the SEC and FINRA. Before trading options, you should:

Read the Options Disclosure Document (ODD) titled "Characteristics and Risks of Standardized Options," available from your broker or at The Options Clearing Corporation (OCC).
Understand that options trading requires approval from your brokerage and involves risks including the potential loss of your entire investment.
Be aware that options are not suitable for all investors and that you must meet certain eligibility requirements set by your broker and regulators.
Comply with all applicable federal, state, and local laws and regulations governing securities trading in your jurisdiction.

5. Assumption of Risk

    All trading and investment decisions are made solely by you, at your own risk. You acknowledge and agree that:

The value of options contracts can change rapidly and unpredictably due to market conditions, volatility, time decay, and other factors.
Any data, scores, analysis, or suggestions provided by WheelHouse are not guarantees of any outcome.
You are solely responsible for conducting your own research and due diligence ("DYOR") before making any trading or investment decision.
You should consult with a qualified, licensed financial advisor before making investment decisions, particularly if you are unfamiliar with options trading.
You should never trade with money you cannot afford to lose.

6. No Fiduciary Relationship

Your use of WheelHouse does not create a fiduciary relationship, advisory relationship, principal-agent relationship, or any other special relationship between you and Wagon Wheel Trading. We owe you no duty of care, loyalty, or best interest obligation with respect to your trading or investment decisions.

7. Data Accuracy and Reliability

Market data displayed on WheelHouse is sourced from third-party providers and may be delayed, inaccurate, or incomplete. We do not guarantee the accuracy, completeness, timeliness, or reliability of any data, including but not limited to:

Stock prices, option prices, bid/ask spreads, and volume data
Implied volatility, delta, and other calculated metrics
Earnings dates, market capitalization, and fundamental data
Historical prices used in backtesting simulations

Data may be especially unreliable outside of regular U.S. market hours (9:30 AM – 4:00 PM ET). You should always verify data with your broker before placing any trade.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAGON WHEEL TRADING, ITS OWNERS, OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

Losses or damages arising from trading decisions made based on information obtained through WheelHouse
Losses resulting from inaccurate, delayed, or incomplete data
Losses from system downtime, errors, or interruptions
Loss of profits, revenue, data, or business opportunities
Any other losses arising from your use of or inability to use the service

THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify, defend, and hold harmless Wagon Wheel Trading, its owners, operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the service
Your trading or investment decisions
Your violation of these Terms
Your violation of any applicable law or regulation
Any content you submit through the service (comments, feedback, etc.)

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. User Accounts and Subscriptions

You are responsible for maintaining the confidentiality of your account credentials. Paid subscriptions are billed monthly through Stripe and can be cancelled at any time through the account settings portal. We reserve the right to suspend or terminate accounts that violate these Terms.

Refund Policy

When you cancel a paid subscription, you retain access to paid features for the remainder of your current billing period. No prorated refunds are issued for partial billing periods. After your current period ends, your account will revert to the free tier and your data will be archived for 90 days.

If you believe you were charged in error or experience a billing issue, please contact us through the feedback form within 14 days of the charge. We will review requests on a case-by-case basis and may issue a refund at our sole discretion.

12. User-Generated Content

Blog comments and feedback submitted through WheelHouse must not contain financial advice, specific trade recommendations directed at other users, illegal content, spam, or harassment. We reserve the right to remove any user content at our discretion.

13. Third-Party Services

WheelHouse integrates with third-party services including Stripe (payments), Google (authentication), and market data providers. Your use of these services is governed by their respective terms. We are not responsible for the availability, accuracy, or conduct of third-party services.

14. Intellectual Property

All content, features, and functionality of WheelHouse (excluding third-party data and user content) are owned by Wagon Wheel Trading and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Hawaii, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved in the courts located in the State of Hawaii.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wagon Wheel Trading regarding your use of the service.
